Birth*Herbert French Atkins was born in August 1864 in IllinoisG.1 
Death*He died on 6 February 1944 in Alameda County, CaliforniaG.2 
He was attending graduate school at Cornell University in 1887-88, being listed in the 1888 Cornell catalog. It said he got his A.B. degree from Illinois College. He then apparently changed to Harvard University, where he attended from 1888-94 ending up with a law degree.

When the 1900 census was taken Herbert and a few others were boarding in a home headed by a woman named Minerva Scott in Jacksonville, Ill.

When he was married in June 1901 the following notice appeared in the 28 Jun 1901 issue of the St. Louis Republic newspaper on p.8: "Girl for His Bride: Jacksonville, Ill., June 27.--The marriage of Miss Helen Dawson to H.F. Atkins was solemnized this evening. The groom is a graduated of Illinois College and of the Harvard Law School, and before locating here practiced in St. Louis. He is prominent in Odd Fellows, Masonci, K.P. and B.P.O.E. circles."

In the 1902 city directory of Jacksonville he was listed as a lawyer working out of rooms 1 and 2 in the Scott Block.

The 1912 directory of Redlands, California has Herbert F. Atkins and wife Helen M. living at 40 1/2 Nordina Street, and occupation was orchadist. The following year the Harvard Alumni Directory gave his address as 53 East Cypress Avenue in Redlands. The 1919 Harvard directory has him at 3680 Fifth Avenue in Los Angeles.

In 1914 he was badly injured in a train accident in New York and his life spiraled downward from there. The following newspaper account offers the following sad story: "Harvard Man, Duped by Life, Made Vagrant. Arrested for sleeping in restaurants on Telegraph avenue in Berkeley, Herbert F. Atkins, 72, addressless and unemployed, told a sad story yesterday to Police Judge Youngs in Berkeley. 'I'm a Harvard graduate, your honor,' he said. 'I was a professor of law at Columbia. Nineteen years ago I was in a New York train accident. As a result of that accident I spent twelve years in hospitals. When I came out all my family and relatives were dead. My memory had been impaired. I've been a wanderer ever since.' Judge Youngs questioned Atkins at some length with technical legal questions. 'You certainly know your law, said the court.' 'It doesn't do me any good,' said Atkins. 'I can earn enough at odd jobs to eat. But my problem is finding a place to sleep, and so I've been sleeping in restaurants.' At this juncture Policeman Henry Whaley, who had arrested him, offered to take charge of Atkins and help him find a home. The court turned the aged man over to Whaley's custody." (San Francisco Chronicle, 28 Apr 1933, p.5) The San Diego Union of 29 Apr 1933, p.10 also covered the story, adding a bit more detail, including that the accident was in 1914 and that he was "forced to a hospital for 12 years."

In the 1940 census he appears as a divorced 75-year-old laborer living in Oakland, California, renting a place on Brush Street. It said he was in the same place in 1935.

  1. He was age 5 in the 1870 census of Jacksonville, Ill., 15 in 1880, and in 1900 it gave his date of birth as Aug 1864. All sources say he was born in Illinois. His death record in California gives a birthdate of 1 Jan 1862 but this is probably incorrect. He was living alone at the time and it's probable the information on his birth wasn't readily available.

There is no proof that this is the Martha who married Nathaniel Rich. The fact that his father had another daughter Martha born 5 years after her suggests that the first Martha died young, but it seems like the second Martha married a Barnabas Paine, leaving the first to be the spouse of Nathaniel Rich. The gravestone ages of both Marthas - Rich and Paine - match up with their birth dates. In the case of Martha Paine, the date is only two days off, while Martha Rich was 82 in Dec 1840, suggesting 1758. More research is necessary to prove both of these marriages.
